Myanmar refugee charged with murdering baby



SHAH ALAM: A Myanmar refugee who allegedly stabbed her newborn baby to death has been charged in a magistrate’s court here.
Nur Aishah Abdullah, 23, was charged under Section 302 of the Penal Code with murdering her baby girl at No 4, Lot 9902, Batu 4, Kampung Jawa, at about 9am on Jan 25.
The accused, who has a United Nations High Commission for Refugees card, had allegedly stabbed the baby five times with a knife. If convicted, she could face the mandatory death sentence.
The accused: Nur Aishah, who was charged with stabbing her newborn baby to death, being led away Friday.
Magistrate Zilfinaz Abbas ordered Nur Aishah to be sent to Hospital Bahagia for observation.
She also fixed Feb 28 for the case to be mentioned.
Deputy public prosecutor Zara Aina Mohd Zawawi appeared for the prosecution.

LITERATURE REVIEW

Baby dumping began at the early 1989, when a police dispatcher was arrested and charged with abandoning her newborn baby in a litter scattered lots. The perpetrators was Brenda Flood, was charged with endangering the welfare of a child abandonment and reckless endangerment.
Later, at June 1994, a woman admitted that she dumped the baby in a trash can after giving birth. She testified Thursday that she did not call 911 because the child was already dead. Doctors testified for the prosecution that the baby's lungs revealed signs that the baby at her last death was gasping for air.
The baby dumping issue then continued on 1997, when one baby was saved from death on 25 August by members of the Woman and Child Abuse unit, hours after being exposed to the elements after being deserted by her 20-year-old mother. The mother, who was later charged with attempted murder, was only apprehended after she voluntarily surrendered herself to the authorities 10 days after she had abandoned her baby.
Then, the baby dumping issues has never to be seen declining nor diminishing Up until 2010, there is still an increase in the number of baby dumping around the world. For the Malaysia it self, baby dumping has increased so much to the extent of worrying stages.
According to the statistics of baby dumping cases in Malaysia issued by the Headquarters of the Royal Malaysia Police (PDRM), Bukit Aman, in 2000 a total of 65 cases of baby dumping have been reported throughout the country. this was serious case and should be aware by the community. Dumping babies become more serious among teenagers in Malaysia due to pour guidance from parents, lack of religious education and uncontrolled social life.
In a period from 2008 to 2009 there are 181 cases of baby dumping was recorded while 60 cases was recorded in 13 August 2010. To overcome this problem government has decided that the issue of baby dumping will be investigated as a murder case. It can carry the death penalty or in maximum prison sentences of 20 years. In addition, it has agreed to the proposal by the Woman, Family and Community Development Ministry over the issue because incidents of baby dumping were still rampant in the country ( Minister Datuk Seri Shahrizat Abd Jalil).

On the other hand, the problem happens because new mother especially the young mothers cannot think wisely when they throw away the baby. They felt pressure with their emotional and physical changes because it is their first experience and they do not expect the changes will occur.

DEFINITION OF BABY DUMPING

According to the Headquarters of Royal Malaysia Police (PDRM) baby dumping means that the acts of leaving away the babies at any places without taking care of the babies. Similary with Prof Dr. Harlina Siraj says baby dumping is a social crisis and has a cronic increase as many cases are occuring in Malaysian society.

The baby dumping refers to discarding or leaving alone, for an extended period of time, a child younger than 12 month of age in a public or private setting with the intent to dispose of the child. It is a crime which  happens when close proximity is commited between a guy and a women and resulted in unwanted baby.

The baby dumping issue arise when the woman had her unplanned pregnancy and been pressured by the question about the status of the child. Beside they may feel that they are not yet ready for his responsibility. In terms of tradition”, young women fear rejection by their parents and the community if they are found to have had a baby outside of marriage. This tradition will absolutely increase the cases of baby dumping. Pregnant women that are rejected by their boyfriends, who may even deny being in any relationship with the woman and the child may then dump the baby because she fears that she will be unable to look after the child alone, or to afford the child’s maintenance. In conjunction prostitution also will cause baby dumping

INTRODUCTION

Hello everyone.......
As we know, nowadays many social issues have arisen in Malaysia among teenagers especially baby dumping. This is because they do not have guidance from their parents and the level of religious education is very limited. According Datuk Seri Sharizat Abd Jalil, as women, family and community Development Minister, Selangor recorded the highest number of baby dumping. Lately the issue of baby dumping is very serious because it involves many people such as themselves, family and community in our country. We choose this topic because as teenagers we have the responsibility to overcome that issue.
In our opinion to solve the problem it must start from the family. The family must play an important role to manage the family.

My name is Nor Faezah Binti Arshad. I'm from Sungkai, Perak. Now I am study at UKM, Bangi. I am study in Political Science programme. Before this I  studing at Sekolah Menengah Kebangsaan Sungkai, Perak. I have 9 siblings and I am number 6. I have 3 brothers, 2 sisters and 3 younger brothers. My father is a settler at Felda Gunung Besout 4, Sungkai Perak and my mother is totally housewife. My second brother works as a fireman at Cheras. His name is Mohd Rosdi. Then, my third brother is Mohd Zaki. He works as a nurse assistant  at Majlis Agama Islam Selangor Dialysis Centre. I have 2 sisters. My first sister is totally a housewife. Her name is Roslinawati and my second sister is studing  at UiTM Seri Iskandar,Perak in Quantitative Science programme. 
There are many things i like to do. I like to read. I like to listen. I like to dream. I like to think. I like to read about politics issues especially in Malaysia. I am very interested to listen whatever about political when somebody talks about that. So, that is why I choose political science course in UKM.

My name is Farhana Binti Jamal. I was born in Malacca on 20 June 1990. Now i'm studying at UKM and my course is Communication and Public Pollicy. At UKM I stay at Kolej Aminuddin Baki. The kolej is near my faculty. Before I go to my further study, I was study at Sekolah Menengah Kebangsaan Iskandar Shah.
I have 6 siblings. 1 brother 3 sisters and 1 youngest sister. I'm the fifth one. My eldest brother's name is Khairul Nizam Bin Jamal. He is married with a gurl from Kelantan and they have one child. My brother works as a goverment officer at Bandar Baru Bangi. My first sister's name is Nizawati Binti Jamal. She works as a shift manager at KFC. My second sister's name Norzilah Binti Jamal. She works as a quantity surveying at Johor Bharu. I have one sister working as a nurse at Institut Jantung Negara. Her name is Nordiyana Binti Jamal. My youngest sister passed PMR and she got straight As. She is schooling at Sekolah Mengah Sains Muzaffah Syah Melaka.

My name is Nur Fadzlun Binti Johan.  I come from Pontian, Johor. My birthday 30.11.1990. I have 5 siblings and  i am number 5.  I have 2 brothers and 2 sisters. My elder sister passed away because she had cancer. My parents do not work anymore. They have retired from the government. So, now they are farmers. I am from science political course. I like political subject very much. I don't know why but i like it very much. My ambition is to analise  politics like Prof Agus is one lecturers in my program. When i was at school , my favourite subjet was Pengajian Am. So, my favourite subject is related to my course now. My least favourite subject was Additional Mathematics because the subject has many  formula to remember. When  i finish my study , i want working with SPRM. That is because  i like work which is challeging. If  i do not get work with SPRM, i want to work  as a political analyst.
